KTS Tulsi - Gender Neutral Rape Bill 2019
MP becomes MAN in the Parliament
2019, the year, when a Member of Parliament decided to become the MAN in the Parliament.
Shri KTS Tulsi, a respected Member of Parliament from Rajya Sabha is presenting a Private Member Bill. The Private Member Bill, named, "The Criminal Law (Amendment) Bill 2019" is one of the first bills ever presented by an MP keeping the true spirit of Article 15 of the Constitution of India.
Few of the Salient features of the Bills include:
- Amendment in IPC Section 354, 354A, 354B, 354C, 354D to replace "woman" with "person".
- Amendment in IPC 375 to replace "woman" with "person".
- Insertion of IPC 375A to sexual assault and it's punishment where inappropriate touching also is proposed to be a Bailable offence with 3 years imprisonment, in Gender Neutral Manner.
- Amendment in IPC 376, 376A, 376C, 376D to replace "woman" with "person".
- All the above amendments are suggested to cover men, women, transgenders alike under the amended/new laws.
- Other Amendments to bring effect of above 4 amendments/insertions.
The bill gives a very comprehensive view of how, with a right intention, a right thing can be smoothly done.
The Hon'ble MP has kept the ethos of the Constitution of India intact by writing it in BOLD & on the wall that Crime, Victim, Perpetrator - NO ONE HAS GENDER.
This Bill is a right step after that observations of the Law Commission 172nd report which strongly recommended the Laws w.r.t. to Sexual Assault to be gender neutral. Under feminist pressure, even the Ordinance of keeping rape laws as Gender Neutral was junked. Thus, it made India, a unique country of Law making process to be governed and ruled by feminists.
Hon'ble Supreme Court of India, bench of Hon'ble Chief Justice of India (Shri Ranjan Gogoi) & Hon'ble Justice Sanjay Kishan Kaul, while dismissing the PIL on Gender Neutral Rape Laws, in the case of, Criminal Justice Society of India vs Union of India (W.P. (C) No. 1262.2018), stated:
"the issues raised pertain to legislations to be made by
the Parliament, for which adequate recommendations have
already been made by the Law Commission.
The petitioner may seek such other remedy, as may
be available in law."
The Bill draft also refers to India's obligation towards UDHR (Universal Declaration for Human Rights), as a signatory, to give the fundamental right of equality before law to every person in Article 6 and Article 7.
As a result, SIF Delhi's NGOs i.e. Save Family Foundation (SFF) and Men Welfare Trust (MWT) have issued Letter of thanks to the Hon'ble Member of Parliament for being the MAN in the Parliament.
This Blog is also to thank Shri KTS Tulsi, Hon'ble Member of Parliament, Rajya Sabha for taking this path-breaking step towards believing in the Constitution of India.
Infact, this is exactly what Men's Rights Activists (MRAs) always demanded - GENDER NEUTRAL LAWS.

ReplyDeleteGreat proposal. Really a shame how much feminists groups have actively fought against gender neutral rape laws in India. They say it's because rape is a female issue, but the reality is that males are sexually abused nearly as much as females and in some places more
